Day 5 of WHO INB 13, negotiations on a pandemic agreement

KEI’s morning intervention:

KEI thanks the WHO for approving a 1pm side event, in room W1, where several NGOs will provide reflections on this negotiation.

On a different note, among the recent events that have shocked the world are attacks on global health and humanitarian programs. The outcomes for Chapter 11, technology transfer, should be fit for a world where developing countries cannot be expected to depend on donor largesse to protect their populations.

Negotiators can accurately describe the obligations in the agreement for technology transfer as having a voluntary nature, but should avoid all attempts to define technology transfer itself as only legally or practically possible when voluntary. The “without prejudice language in the Article 11 footnote needs to include the word “other,” as in “without prejudice to other measures that parties may take.” The word “other”, which is missing from some proposals, makes it clear that non-voluntary measures are possible when voluntary measures are not available or adequate. This should be obvious, but remains unfortunately a problem in some versions of the footnote.
