Knowledge Ecology International statement on 7(f): Opposition Systems
Thank you Mr Chair, for providing Knowledge Ecology International (KEI) with the opportunity to provide some thoughts on the Committee’s work on opposition systems.
The SCP should conduct studies on the costs of resolving disputes over patent validity, both through litigation before a court, or through pre or post grant opposition proceedings.
The cost of resolving disputes over patent validity is an often overlooked issue. The SCP would benefit from a much deeper understanding of what those costs are, and how they differ from country to country.
The SCP should also examine new ways to share information that is obtained in various proceedings that examine the validity of patent, such as a database of judicial and non-judicial opposition proceedings for particular patents.
